A Measurement to Realisation of Equality and Non-Discrimination Clauses within the Rule of Law

Abstract
This article starts from the point that a threefold operative approach is necessary to realise equality and nondiscrimination clauses: that of legislators, that of judges and that of Public Administrations. All three of these authorities must necessarily come together in a coherent unity. None of the three may be omitted in a rule of law, as this would contravene the very assumptions inherent in the rule of law. This combines with yet another threefold approach comprising consideration of equality and non-discrimination clauses as a value, a principle and a fundamental right. Each of these sections is then analysed within the context of the European Union.
